Nothing in this Policy excludes, restricts or modifies any rights or remedies that cannot legally be excluded, restricted or modified under applicable law, including the Australian Consumer Law where it applies.1. Consumer Rights
Our goods come with guarantees that cannot be excluded under the Australian Consumer Law.You are entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage.You are also entitled to have the goods repaired or replaced if the goods fail to be of acceptable quality and the failure does not amount to a major failure.These consumer guarantees apply automatically where the Australian Consumer Law applies and are not affected by any voluntary return or refund policy offered by CAIREL.2. If a product needs to be returned because of a confirmed product fault or another issue covered by applicable consumer law, CAIREL will provide the remedy required by law.
Where applicable, reasonable return costs incurred by the consumer will be handled in accordance with applicable law.

Where a refund is required or approved, CAIREL will generally issue the refund using the original payment method, subject to the procedures of the relevant payment platform.
The time required for a refund to appear in your account may depend on the payment provider, bank or card issuer.
Where a refund is required under applicable consumer law, CAIREL will process the refund in accordance with those legal requirements.5. Change of Mind
If you change your mind about your purchase, CAIREL offers a voluntary return window of 10 days from the date the product is delivered.To be eligible for a change-of-mind return:- The return request must be made within 10 days of delivery;
- The product must be unused and in its original condition;
- The product must not have been damaged, modified or altered after delivery; and
- The product should be returned with its original packaging and included accessories where reasonably possible.Unless otherwise required by applicable law, return shipping costs for change-of-mind returns are the responsibility of the customer.Once the returned product has been received and assessed, any approved refund will generally be issued to the original payment method, subject to the procedures of the relevant payment platform.This voluntary change-of-mind policy does not affect or limit any consumer guarantee or other legal right that applies to a product that is faulty, defective, unsafe, not as described, or otherwise does not meet applicable consumer guarantees.Consumer guarantees under the Australian Consumer Law are not subject to this 10-day change-of-mind period.6. Kickstarter Rewards
NIGHTFALL may initially be offered through Kickstarter as a crowdfunding project.
A Kickstarter pledge is subject to Kickstarter's applicable terms and the specific terms of the campaign.
The estimated delivery period shown on the Kickstarter campaign and applicable reward tier represents CAIREL's current estimated timeframe for fulfilment. It is an estimate rather than a guaranteed delivery date.
The actual fulfilment schedule may change due to circumstances such as production, quality control, shipping, customs processing or other factors affecting the project.
CAIREL will make reasonable efforts to fulfil rewards within the estimated delivery period communicated through the Kickstarter campaign and will provide updates to backers if there are material changes to the expected fulfilment schedule.
If a Kickstarter project is successfully funded, CAIREL will make reasonable efforts to fulfil the rewards offered through the campaign in accordance with the campaign terms, Kickstarter's applicable rules and applicable law.
Any refund, cancellation or other remedy relating to a Kickstarter pledge will be handled in accordance with Kickstarter's applicable procedures, the campaign terms and applicable law.7. Damaged, Missing or Incorrect Deliveries
If your order arrives damaged, incomplete or contains an incorrect item, please contact us at [email protected] as soon as reasonably possible after receiving the delivery.
Where possible, please provide photographs of the package, shipping label and product, together with details of the issue.
CAIREL will assess the circumstances and provide an appropriate remedy in accordance with applicable law and the terms applicable to the order.8. Product Safety Issues

Please provide details of the issue and any relevant photographs or video where reasonably possible.
